From its humble and limited
origins in the 1960s, environmental litigation is
now a widely-recognized legal specialty that crowds
the dockets of state and federal courts from a myriad
of perspectives. Environmental Litigation will explore
citizen-initiated litigation in the field of environmental
law. This course will embrace not only traditional
citizens suits under major federal environmental laws
like the Clean Water and Clean Air Acts, but also litigation
under the Administrative Procedure Act from both environmental
and industry perspectives. The course will examine
jurisdictional issues, intervention, fee recovery,
declaratory and injunctive relief, and legal and political
strategy considerations in federal and Montana court. The
course will use both a traditional casebook approach
and case studies of current federal and Montana litigation. Students
will gain substantive knowledge of one or two federal
and/or Montana environmental laws as well. |
