Indian reserved and aboriginal water rights are inextricably intertwined with federal, state and tribal regulatory frameworks throughout the United States. This course will investigate the origin and nature of those Indian water rights; how they differ from state appropriative rights; and how they implicate federal, state and tribal regulatory systems in the areas of (a) aquatic environmental regulation, (b) commerce, energy development and recreation, (c) trans-boundary and climate change issues, and (d) tribal subsistence and cultural resource protection.
Water Law is a prerequisite. Students may complete the advanced writing requirement through this course. |
