SB2-06/07
Resolution Regarding Bond Funds - passed 09/13/06 17Y-3N on a roll call vote

Whereas, The University of Montana took out a bond of $5.75 million, with a fixed annual percentage rate (APR) of 4.14%, to help build a new building for the Office of the Commissioner of Higher Education in Helena;

Whereas, this office building was going to be built in conjunction with the Montana Guaranteed Student Loan Program (MGSLP);

Whereas, MGSLP’s funding was cut by the federal government, preventing them from contributing their financial commitment;

Whereas, it is no longer financially feasible for the Commissioner’s Office to build a new building;

Whereas, The University of Montana now has this money available to do on-campus improvements;

Whereas, there are buildings on campus that are in need of renovations to bring them up to code;

Whereas, this money can also be used to supplement funding for on-campus projects being built primarily with private donations;

Whereas, the opportunity to invest this money will benefit students across the university;

Therefore, Let It Be Resolved that the Associated Students of the University of Montana (ASUM) support the Administration’s plan (see Exhibit A) to devote this unforeseen money to improve certain campus facilities.

Let It Be Further Resolved that ASUM support Academic Facility Fee increases of $50/semester for students in the Journalism and Law programs and $1.25 per credit hour to the Academic Facility Fee for all students.

SB3-06/07 Resolution Amending House Rules: Section 2 - passed 09/20/06 21Y-1N on a roll call vote

Whereas, the Associated Students of The University of Montana (ASUM) Senate consists of leaders elected by the students of The University of Montana;

Whereas, at all levels of government the votes that each elected official makes are recorded for public knowledge;

Whereas, there is no consistent record of individual votes cast on the vast majority of resolutions;

Whereas, the only reflection in the record of the stances each member of the ASUM Senate takes are those that are deemed important enough to require a roll call vote by members of the ASUM Senate;

Whereas, students have varying interests and concerns and may differ in what they believe is important from that of the ASUM Senate;

Whereas, the ASUM Senate and the students of The University of Montana value openness and accountability in those who represent them;

Whereas, every student attending The University of Montana is a constituent of every ASUM Senator and Executive;

Whereas, the ASUM Senate should reflect the ideals that they expect from other elected officials;

Whereas, it is to the benefit of the students of The University of Montana to know how each member of the ASUM Senate chooses to represent the student body;

Whereas, passage with unanimous consent would list every present member of the ASUM Senate as voting in the affirmative;

Whereas, the voting information should be easily accessible to students;

Therefore, Let it be Resolved, that ASUM House Rules Section 2 be amended to read:

K. The final vote on all resolutions voted on by the ASUM Senate requires a roll call vote unless approved by unanimous consent.

Let it Further be Resolved that ASUM be charged with posting the voting record of the ASUM Senate in the ASUM Display Case until the next meeting of the ASUM Senate.

Let it Further be Resolved that making this voting information accessible online be a goal of the ASUM Office Staff and Administration.

SB04-06/07 College of Technology Affairs Committee - passed 09/20/06 21Y-1N on a roll call vote

Whereas, ASUM said that it would “explore new avenues of involving COT student in student government activities” when it dissolved the COT Affairs Committee;

Whereas, instead ASUM dissolved the COT liaison position cutting all significant ties with our COT constituents;


Whereas, College of Technology students deal with a diverse number of issues, often very different from the issues at the mountain campus;

Whereas, most colleges of technology around Montana have their own student government, unlike The University of Montana-Missoula where they are represented under the same provisions as the Liberal Arts College;

Whereas, the channels currently used to get involved with ASUM and student activities are open to all students including the College of Technology; however, it is often harder to get informed about these opportunities and participate due to the separation from the mountain campus;

Whereas, ASUM has a commitment to serve all their constituents;

Whereas, due the special needs that the College of Technology students have separate from their counterparts on the mountain campus, a committee dedicated to serving them is much needed;

Therefore Let It Be Resolved that ASUM Bylaws Article IV be amended to read:
Section 18. College of Technology Affairs Committee (CTA):
A. The COT Affairs Committee shall be composed of seven (7) members, of which three (3) at least one (1) shall be a members of the Senate and four (4) at least two (2) shall be students at-large from the COT. Any student may be a non-voting advisory member of the Committee.
1. The Committee shall be structured so that COT students-at-large will maintain majority of voting membership.
B. A COT student-at-large or an ASUM Senator shall chair the committee.
C. The Committee shall be responsible for all activities occurring on the College of Technology campuses that affect the ASUM.
D. The Committee shall review the ASUM governing documents and recommend changes as necessary to meet the representation needs of students attending the College of Technology.
E . The Committee shall meet on the College of Technology campuses.

SB05-06/07 Resolution Temporarily Increasing the Limit on Billable Hours in Personnel Policy 3.0 - passed 09/20/06 with unanimous consent

Whereas, UM Productions is an agency of the Associated Students of The University of Montana (ASUM) whose personnel policy is governed by ASUM Personnel Policy;

Whereas, the Personnel Policy 3.0 limits the number of billable hours in a month to eighty (80) for the UM Productions Program Director, Pop Concert Coordinator and Performing Arts/Special Events Coordinator (currently known as Production Assistant);

Whereas, UM Productions is spearheading the effort to prepare for the Rolling Stones concert at Washington-Grizzly Stadium;

Whereas, the Rolling Stones concert will take far more effort and man-hours than any concert UM Productions staff has worked on before;

Whereas, the UM Productions Program Director, Pop Concert Coordinator and Production Assistant will all be working even further beyond their allotted hours than they already do;

Whereas, an increase in the billable hours for UM Productions employees would be funded from the budget of UM Productions, would require no additional funding from the ASUM Senate, and would not cause any financial difficulties for UM Productions;

Therefore, Let It Be Resolved that the Senate of the Associated Students of The University of Montana increase the number of billable hours for UM Productions Program Director to one hundred four and two/thirds (104.667) hours and the Pop Concert Coordinator and Production Assistant to one hundred six and two/thirds (106.667) hours, with overtime, for the first two-week pay period in month of October. (See Exhibit A.)

SB06-06/07 Resolution on Segway Purchases - passed with unanimous consent 10/11/06

Whereas, students at The University of Montana are against misappropriated spending and gross misspending;

Whereas, the benefits of using Segway personalized motorized transportation devices are not significant enough to justify the purchase of these devices;

Whereas, the use of these devices are extremely limited by weather conditions during the academic year;

Whereas, the upkeep and maintenance of these devices is expensive;

Whereas, the Office of Public Safety’s purchase of several new Segway personalized motorized transportation devices is an example of gross misspending;

Whereas, parking problems and parking efficiency on the campus of The University of Montana will not be resolved by this purchasing;

Whereas, a bicycle would be a sufficient and efficient alternative to these devices;

Whereas, any continued spending on personalized motorized transportation devices would be a continued example of gross misspending;

Therefore, let it be resolved that the Associated Students of The University of Montana (ASUM) disagree with the past purchase and discourage any future purchase(s) of personalized motorized transportation devices.

Whereas, the legality of Item 2, Section 4 of the ASUM Personnel Policy is questionable;
Whereas, working volunteer hours beyond the designated base hours is, and ought to be, a matter of honor and pride for ASUM employees and not a condition for their employment,

Therefore, Let It Be Resolved that ASUM amends its Personnel Policy Item 2, section 4 to read:

2.4 Positions with monthly designated base hours may not be compensated beyond that base. Any exceptions to this rule must be approved by the ASUM Executives and Senate. The Senate may provide retroactive approval for any exemptions made by the Executives during periods when the ASUM Senate is not regularly in session.

SB08-06/07 Resolution regarding Accessibility - passed 10/18/06 with unanimous consent

Whereas, The Associated Students of The University of Montana (ASUM) and their dedication to accessibility have recently been called into question by both letters to the editor and articles in The Montana Kaimin;

Whereas, the ASUM strive to be proactive regarding accessibility concerns;

Whereas, the ASUM have been diligently working to address accessibility issues with ASUM agencies and services, especially ASUM Transportation;

Whereas, the ASUM work with various University committees and groups to make UM more accessible to students;

Therefore, Let It Be Resolved that The Associated Students of The University of Montana (ASUM) reaffirm their strong stance in support of making ASUM agencies and services accessible to students at The University of Montana;

Let It Be Further Resolved that the ASUM will work to further build relationships with the Alliance for Disability and Students at The University of Montana (ADSUM) and identify accessibility issues with ASUM agencies and services, as well as on campus;

Let It Be Further Resolved that the ASUM will strive to continue to make The University of Montana accessible to all students.

SB09-06/07 Resolution Thanking MountainLine - passed 10/25/06 with unanimous consent

Whereas, ASUM Transportation works on a relatively tight budget and finds it difficult to locate funds for new buses;

Whereas, Mountainline Transportation gave ASUM Transportation two new buses, the first on August 31, 2006, and the second on September 28, 2006,

Whereas, students have been left at South Campus for lack of space on the buses, and the two donated buses have a larger ridership capacity than any of our other buses;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana formally thank Mountainline for their generous donation of two buses to ASUM Transportation.

SB10-06/07 Resolution Endorsing I-151 and joinining the Raise Montana Coalition - passed 10/25/06 17Y, 2N on a roll call vote

Whereas, the State of Montana has not had a minimum wage increase since 1996;

Whereas, according to the Center on Budget and Policy Priorities and Economic Policy Institute, the purchasing power of minimum wage has deteriorated by 20% since September 1997. After adjusting for inflation, the value of minimum wage is at its lowest level since 1955;

Whereas, the two largest student employers on campus, University of Dining Services and UM Productions, have a combined student employment of 901 students who are currently earning less then the proposed increase;

Whereas, the Associated Students of The University of Montana (ASUM) have a strong history of supporting minimum wage increases in the state legislature;

Therefore, Let It Be Resolved that ASUM support I-151.

Let It Be Further Resolved that ASUM join the Raise Montana Coalition.

SB11-06/07 Resolution Regarding Sustainability - passed 11/01/06 with unanimous consent

Whereas, in 2003 President Dennison signed the Tallories Declaration for The University of Montana;

Whereas, bullet point five of the Tallories Declaration states, “we agree to set an example of environmental responsibility by establishing institutional ecology policies and practices of resource conservation, recycling, waste reduction, and environmentally sound operations;”

Whereas, the ASUM has a unique opportunity to be leaders in the movement to implement aspects of this declaration;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana pledge to work towards a sustainable and ecologically friendly campus;

Let It Further Be Resolved that the ASUM and affiliated agencies will pledge to use 100% post consumer product paper for general printing uses;

Let It Further Be Resolved that the ASUM encourages departments and organizations on campus to implement aspects of the Tallories Declaration, including using 100% post consumer product paper.

Let It Further Be Resolved that a copy of this resolution be sent to all campus departments and organizations.

SB12-06/07 Resolution to amend ASUM Bylaws Article III, Section 2 - passed 11/01/06 with unanimous consent

WHEREAS Article III, Section 2E no longer exists within the ASUM Bylaws;

THEREFORE, LET IT BE RESOLVED that ASUM Bylaws Article IV, Section 2 be amended to read:
Section 2. Relations and Affairs Committee:
A. The Relations and Affairs Committee shall be composed of nine (9) members, four (4) of which shall be Senators.
B. The Relations and Affairs Committee shall be responsible for recommending all changes to the ASUM Bylaws and ASUM Personnel Policy.
C. The Relations and Affairs Committee shall work on unbiased projects, ideas, or campaigns intended to increase student involvement in and student awareness of ASUM government in general or any particular issue(s) pertaining to ASUM.
D. The Relations and Affairs Committee shall be responsible for all activities occurring on the University campus that affect ASUM and students. These activities include, but are not limited to: auxiliary service fees and operations, campus development plans, campus security, environmental health, insurance, parking, university athletics, computer fees, academic issues, library operations, long-range building plans, international student affairs, student health service, drug and alcohol policy, and building and equipment fees.
E. The Barbara Hollmann Administrator of the Year Award
1. At the last meeting of the outgoing ASUM Senate, this honor shall be presented to the recipient.
2. The recipient shall be chosen by the Relations and Affairs Committee through a nomination and discussion of potential recipients.
3. The recipient shall be judged on his/her ability to champion student issues.
4. The recipient must show a willingness to include students throughout the entire decision-making process on campus-wide issues.
5. The recipient must also show a willingness to listen to students with the goal of understanding concerns.
F. The Relations and Affairs Committee shall enforce and oversee the execution of Article III, Section 2E of the ASUM Bylaws. Therefore, a motion passed by a two-thirds majority vote in the Relations and Affairs Committee can and will result in an unexcused absence for an ASUM Senator failing to accord with Article III, Section 2E of the ASUM Bylaws. Such decisions of the Relations and Affairs Committee may be repealed by a simple majority vote of the ASUM Senate.

SB13-06/07 Resolution regarding UM Apparel - passed 11/08/06 with unanimous consent

Whereas, The University of Montana is an institution of higher education committed to educating students to be "informed, ethical, and engaged citizens of local and global communities";

Whereas, the current system of sublicensing Grizwear? through the Collegiate Licensing Company offers insufficient information about the source of the apparel;

Whereas, the Collegiate Licensing Company has a loose affiliation with the Fair Labor Association, which lacks the monitoring capability that the Worker Rights Consortium provides;

Whereas. affiliating with the Worker Rights Consortium will supply The University of Montana with essential information regarding currently unreported factory conditions, making these reports available to all students, faculty, and staff;

Whereas, signing on to the WRC's Designated Suppliers Program will allow The University of Montana to shift Grizwear? manufacturing to factories that promote fair labor standards thus enforcing UM's purchasing code of conduct;

Whereas, The University of Montana has the responsibility to promote fair labor standards in it’s business endeavors;

Whereas, Montana received a grade of F for “Affordability” in Measuring Up 2006: The National Report Card on Higher Education;

Whereas, the average debt-load of graduating UM students is upwards of $20,000;

Whereas, there is a widening rift between the rise in the average household income and the increases in the cost of higher education for Montana’s students;

Whereas, these rising tuition costs and substantial debt loads have begun to discourage Montana high school graduates from attending college;

Whereas, UM President George Dennison proposed a plan entitled Montana Partnering for Affordable College Tuition (MPACT) that was approved on a provisionary basis for one year by the Montana Board of Regents;

Whereas, the MPACT program helps reduce debt load of students by roughly half, to an average of $10,000;

Whereas, MPACT program eligibility is based upon both financial and academic criteria;

Whereas, these eligibility requirements help ensure that academically successful students from low-income families can afford college;

Whereas, the number of currently enrolled UM students who meet the criteria is roughly double that of those who had previously enrolled without assistance;

Whereas, the program has been successful and has helped students;

Therefore, Let It Be Resolved that The Associated Students of The University of Montana (ASUM) thank President Dennison for his commitment to making higher education affordable to Montana students.

Therefore, Let It Be Further Resolved that the ASUM encourage the Montana Board of Regents of Higher Education to continue the MPACT program at The University of Montana.

SB15-06/07 Resolution Regarding Governor Schweitzer’s College Affordability Plan (CAP) - passed 11/01/06 with unanimous consent

Whereas, tuition in the state of Montana has been on the rise since 1991;

Whereas, there is a widening rift between the rise in the average household income and the rises in the cost of higher education for Montana’s students;

Whereas, Governor Brian Schweitzer’s proposed College Affordability Plan (CAP) would hold in-state tuition at current levels for the next biennium;

Whereas, this hold will involve an additional $50 million in state support to help supplement rising operating costs of institutions of higher education;

Whereas, a hold in tuition increases will help ensure that Montana residents will not have to face the continually rising costs of higher education;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana (ASUM) thank Governor Brian Schweitzer for his proposal to cap CAP in-state tuition and promise to make college affordable for Montana residents.

SB16-06/07 Resolution condemning ‘Taser’ use by the Department of Public Safety - failed 11/29/06 6Y, 13N on a roll call vote

Whereas, the use of ‘Taser’ guns are both dangerous and unnecessary, especially on The University of Montana campus;

Whereas, the recent events at The University of California Los Angeles are evidence that the use of ‘Tasers’ are not only threatening to students and their ability to learn, but they also have potential legal repercussions that could be detrimental to The University of Montana and the Office of Public Safety;

Whereas, the Office of Public Safety has not shown that ‘Tasers’ are an effective method of deterrence;

Whereas, the students of The University of Montana believe that situations should be resolved peacefully;

Whereas, the use of ‘Taser’ guns are a violent method to conflict resolutions;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana call upon the Office of Public Safety to discontinue the use of ‘Taser’ guns.

SB17-06/07 Resolution Amending ASUM Bylaws, Article III, Section 14 - passed 11/29/06 17Y, 1N, 1A on a roll call vote

WHEREAS, the ASUM Transportation Board meets frequently and rigorously, and the ASUM Bylaws do not provide for necessary flexibility in committee structure;

WHEREAS, students’ trips to school begin when they leave home and end when they arrive at class. As per the ASUM Office of Transportation’s Mission Statement, it is in the best interest of students for the Board to take an active role in transportation planning around the Missoula area;

THEREFORE, LET IT BE RESOLVED that ASUM Bylaws, Article III, Section 14 be amended to read:

Section 14. Transportation Board:
A. The Transportation Board shall be composed of no less fewer than eight (8) six (6) five (5)and no more than ten (10) nine (9) voting members, of which no less than three (3) and no more than four (4) will be members of the ASUM Senate, no less than two (2) three (3) and no more than five (5) will be students-at-large, one (1) will be a resident life representative, and one (1) will be t The ASUMOT Director shall be an ex-officio member of the Board.. If possible, one (1) member will be a representative from residence life. The Transportation Advisory Board will consist of transportation oriented groups, agencies, and individuals. The ASUM Transportation Board will meet a minimum of twice monthly. The Advisory Board will meet with the Transportation Board at two of these meetings per year. Committees will be made up with members from either the Transportation Board and/or the Advisory Board.
B. The committee Board shall be chaired by the ASUMOT Director, who shall vote only in the case of a tie a student member of the Board. If the chair is a student-at-large, he or she and the ASUM President must arrange a method to regularly brief the senate on actions of the Board.
C. Quorum shall consist of a simple majority of those members currently holding positions. This committee The Board shall meet and have quorum at least two (2) times per month during the academic year.
D. The Board shall, if needed, establish relevant sub-committees which may include a) Fees and Finance, b) Bike and Pedestrian Safety, and c) Transportation Planning.
D. E. Duties and functions of the Transportation Board include:
1. Annually reviewing the ASUMOT budget, the transportation fee, the services provided by ASUMOT, and the performance of the ASUMOT Director;
2. Giving a binding vote on projects amounting to 2% or more of the ASUMOT budget;
3. Submitting for approval to the ASUM Senate any project which a) amounts to 6% or more of the annual ASUMOT budget, and b) is approved in committee by anything less than a unanimous decision of all members present.
4. Meeting with a variety of transportation oriented groups, agencies, and individuals for input and planning.
5. Taking steps to influence transportation planning in the greater Missoula area. The Board shall review transportation projects in the Missoula area and evaluate them for sustainability, cost effectiveness, quality of life influences to neighborhoods, ease of accessing transit, connectivity and access to trail systems and influence on bike and pedestrian safety. The Board shall issue position statements when appropriate encouraging responsible transportation development.

4. 5. 6. Developing a short term (one year) plan to be decided at the first meeting within the first three meetings of each academic year. A long range (five three or more years) planning goals is to be decided upon at the first meeting of this committee plan shall be developed throughout the academic year to serve as guidance for future Boards. This plan should be finalized no later than March 31 of each year. Both plans may be amended at any point with a two-thirds (2/3) majority

SB18-06/07 Resolution Regarding Reconfiguration of Russell and South Third Streets - passed 11/29/06 16Y, 3N on a roll call vote

WHEREAS, many students walk, bike, or use public transit to get to campus;

WHEREAS, affordable housing is difficult for students to find in Missoula;

WHEREAS, a five-lane roadway on Russell Street would decrease pedestrian and bicycle safety, increase vehicle speeds, remove good housing stock from the core of Missoula, negatively affect neighborhood character, induce additional traffic and create a Reserve-style street in the core of Missoula;

WHEREAS, the supposed need for a five-lane roadway is justified based on straight-line traffic projections and does not take increased use of public transit and other alternative means of transportation into account;

THEREFORE, LET IT BE RESOLVED that the Associated Students of The University of Montana (ASUM) do not support a five-lane option with 12.5-foot travel lane widths on Russell Street. ASUM will also oppose any plan that calls for removing an excessive number of houses.

LET IT FURTHER BE RESOLVED that ASUM will support a three-lane system with center turn lanes and single lane roundabouts on Russell Street and a two-lane system with single lane roundabouts on South Third Street. ASUM also supports bulb-outs at intersections, speed tables, pelican crossings and turning lanes when appropriate, and trail underpasses.

A representative from the ASUM Office of Transportation shall attend the Broadway Charette and encourage the City of Missoula and the consultants involved in the planning process to consider a roundabout system at the intersection of Broadway and Russell Streets as an efficient intersection system as well as an attractive gateway to the downtown area.

SB19-06/07 Resolution Regarding Internet Routing Policy - withdrawn 02/07/07

Whereas, Montana Tech of The University of Montana in Butte currently has its internet routed to The University of Montana - Missoula (UM) and then to its final destination;

Whereas, The University of Montana - Western in Dillon also provides the internet by running it through the UM campus;

Whereas, the College of Technology in Missoula (COT) also has the internet run though the UM;

Whereas, the UM and Montana Tech have not been able to provide the needed speed required by the students, faculty, and staff using the internet;

Whereas, Montana Tech’s internet is operating at a crawling speed at best, and web pages are regularly dropped due to the fact that the web page could not be uploaded or downloaded in time;

Whereas, Montana Tech has video conferences with people in Saudi Arabia, which is slowing down the internet for UM and Western;

Whereas, UM has more people using the internet than Montana Tech or Western and therefore slows the internet for Montana Tech and Western;

Whereas, it would be best and most efficient for each college and university to provide their own internet connection without being routed through the UM campus;

Therefore, Let It Be Resolved that ASUM encourage each school to provide their own internet connection and not run every campus through the UM campus.

Therefore, Let It Be Further Resolved that ASUM would consider The COT an exception due to the COT’s proximity to the UM campus to save on funds. ASUM would not encourage this if it is cheaper to have the COT provide its own internet connection.

Therefore, Let It Be Further Resolved that after ASUM votes on this resolution, upheld or not, that a copy be sent to Montana Tech and Western’s student body government asking them to take up this issue as well.

SB20-06/07 Resolution In Support of Washington-Grizzly Stadium Expansion and Corresponding Fee Increase - passed 12/06/06 19Y, 2N on a roll call vote

Whereas, The University of Montana Department of Athletics has proposed an expansion of 2000 seats on the east side of Washington-Grizzly Stadium, to cost approximately $5 million;

Whereas, this project would begin construction after the Fall 2007 football season, to be completed for the Fall 2008 season;

Whereas, Athletics is fundraising from a variety of sources to keep the fee increase as small as possible;

Whereas, the Bookstore and University Dining Services will be making contributions to the project because of increased business they receive due to Athletics;

Whereas, Athletics is proposing a Student Athletics Fee increase of $10 per semester for fee-paying students, that will sunset in five years;

Whereas, the graduating class of Spring 2008 will not have to pay the fee because the project will not be completed for their use by the time they graduate;

Whereas, students will receive 750 of the 2000 new seats, or 37.5% of the expansion;

Whereas, the funds generated from the temporary student fee increase are estimated at $1.04 million, or 20.8% of the estimated total cost;

Whereas, the $4.00 ticket fee charged to students attending the games will terminate after the 2006 season as part of this arrangement;

Whereas, after this expansion is paid for, Athletics will be working towards becoming self-sustaining;

Therefore, Let It Be Resolved, that the Associated Students of The University of Montana (ASUM) stands in support of the proposed 2000 seat addition to Washington-Grizzly Stadium.

Let It Be Further Resolved, that ASUM approves a fee increase of $10 per semester, with the graduating class of 2008 not paying, to sunset in five years, in order to help fund the proposed expansion and increased student seating.

SB21-06/07 Resolution Supporting Fee Increase for ASUM Office of Transportation and UDASH - passed 1/31/07 16-0 on a roll call vote; referenda language for both passed 04/23/07

WHEREAS, ASUM Transportation started as a demonstration project to introduce and promote transportation options to the campus community and has been considerably successful at that goal;

WHEREAS, ridership has increased on the ASUM Office of Transportation (ASUMOT) Park-N-Ride service from 3,860 riders during the 1999-2000 school year to a projected 260,000 during the 2006-2007 school year;

WHEREAS, ASUMOT expanded in Spring of 2003 to include a late-night shuttle service called UDASH, which provides over 15,700 rides per academic year;

WHEREAS, in 2005 ASUMOT added a second Park-N-Ride route to East Broadway, on which ridership has tripled in the last year;

WHEREAS, the cost per ride on ASUMOT’s Park-N-Ride is $0.53, which is far less than 25% of the national average of $2.19 per ride;

WHEREAS, ASUMOT promotes bicycling, works on infrastructure projects to make sure that bicyclists are considered and prioritized, develops bike maps, works to improve parking for cyclists, and developed the new Bike Ambassador Program which teaches and promotes safe and responsible bicycling habits;

WHEREAS, promoting and providing transportation options saves students money that directly helps them stay in school and invest in the local economy;

WHEREAS, the cost of operating ASUMOT services is steadily increasing with the cost of fuel, equipment maintenance and labor;

WHEREAS, ASUMOT is currently funded as if it were still a demonstration project, even though the services it provides have expanded greatly since its inception;

WHEREAS, to continue to operate and provide a safe and sustainable service, ASUMOT funding must increase;

THEREFORE, LET IT BE RESOLVED that the Senate of The Associated Students of The University of Montana (ASUM) supports an eight dollar ($8) fee increase for ASUM Transportation and a two dollar ($2) increase for UDASH to fund these services properly.

LET IT FURTHER BE RESOLVED that ASUMOT will then allocate a substantial portion of their budget to upgrading equipment with better access, hiring a Park-N-Ride Road supervisor, and adding a COT shuttle route. ASUMOT will also allocate a substantive increase to bike facility/parking funds and bus fuel funds to continue to provide quality service at the lowest possible cost to students.

LET IT FURTHER BE RESOLVED that the ASUM Senate will submit this proposal to a student referendum in April 2007.

The ASUM Office of Transportation promotes and provides transportation options to the University community. One program, the UM Park n Ride, gives over a quarter million rides annually, despite using 11-22 year-old buses. This alleviates congestion, improves air quality and reduces parking demand on campus. An $8 per semester increase to the Transportation Fee is necessary to continue service. It will provide new buses, better staffing, bus service to the College of Technology, additional bike parking, wage increases for student employees and will cover the rising cost of fuel.

SB22-06/07 Resolution Supporting Revised Plan for Arthur/5th/6th Project - passed 1/31/07 13Y, 3N on a roll call vote

Whereas, the Montana Department of Transportation (MDT), in partnership with The University of Montana and the City of Missoula, has been working on a reconstruction project for the intersections of Arthur and 5th and 6th streets;

Whereas, the original plans put forward by MDT would have turned the intersection at Arthur and 5th Street into a Reserve Street-size intersection by making it 100 feet wide;

Whereas, MDT’s original plans met with strong student and community opposition for its public process, size, lack of safety for pedestrians and bicyclists, and amount of land taken to build the project;

Whereas, in April of 2006, the Associated Students of The University of Montana opposed MDT’s preferred alternative construction plans (SB 54, 05-06), citing specifically the lack of pedestrian and bicyclist safety and the large nature of the project;

Whereas, MDT’s environmental assessment received much opposition from the community and students;

Whereas, The University of Montana has altered MDT’s plan to address student and community concerns;

Whereas, the revised plan reduces the project by 20 feet, removes one north-bound lane of traffic, and one turning lane between 5th and 6th streets, and adds additional lighting and pedestrian amenities;

Whereas, the revised plan also makes Madison a two-way street at the end of lot P, which will reduce confusion for visitors traveling to campus;

Whereas, the revised plan also saves land in Rankin Park;

Whereas, the University’s revised plan is endorsed by the ASUM Transportation Board;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana support the University’s revised plan.

Therefore, Let It Be Further Resolved that ASUM requests that UM and the ASUM Office of Transportation work with community members to explain the benefits of the revised project.

Whereas, the current cost to provide the current internet speed of 45 megabytes is $88,000.00, and the proposed internet speed of 90 megabytes would cost around $110,000.00.

Therefore, Let It Be Resolved that ASUM would encourage Residence Life to accept the proposed increase in the dorm room network from 45 megabytes to 90 megabytes as soon as possible.

Therefore, Let It Be Further Resolved that ASUM would encourage Residence Life to inquire into expanding the bandwidth when the dorm room internet bandwidth reaches 50 to 75% and be ready in case the bandwidth reaches 75 to 100%.

Therefore, Let It Be Further Resolved that ASUM understands that the cost of the internet speed is split between all the universities and would encourage that the increased cost be handled the same way.

Therefore, Let It Be Further Resolved that after ASUM votes on this resolution a copy be sent to Montana Tech and Western’s student body government asking them to take up this issue as well.

Whereas, an environment that encourages the free exchange of ideas is vital to the success of higher education;

Whereas, Montana House Bill 525 would restrict the free exchange of ideas;

Whereas, the language of Montana Board of Regents Policy 302b and 302c already addresses issues concerning professors’ subject matter and composure in university-related settings, while protecting their private rights guaranteed under the First Amendment of the United States Constitution;

Whereas, The University of Montana embraces intellectual diversity as one of the centerpieces of higher education, and as such there are mechanisms in place to safeguard intellectual diversity, protect a student’s academic freedom, and provide for a process to air grievances;

Whereas, students would prefer that the Montana legislature would continue its hard work addressing financial issues facing higher education;

Whereas, university students are capable of distinguishing the difference between fact and opinion;

Whereas, students, professors, deans, administrators and academic departments within the Montana University System are aware of what constitutes topical and appropriate discussions and curriculum content in a classroom setting;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana oppose HB 525.

SB29-06/07 Resolution Amending ASUM Bylaws Article 5, Section 2 - passed 2/21/07 16Y, 3N on a roll call vote

Whereas, ASUM Election Bylaws are outdated and need to be updated;

Whereas, ASUM Election Bylaws are vague and need to be made more specific in nature so that elections run smoothly and without major difficulties;

Whereas, the ASUM Senate should not be changing ASUM Election Bylaws around ASUM Elections in the spring of each year to correct problems that are correctable earlier;

Whereas, the allotted expenditure amounts for the President-Vice President teams, Business Manager candidates and Senate candidates are equal when the allotted expenditure should represent the level of office being sought;

Whereas, ASUM reimbursement for election expenditures is a policy that is sparsely used;

Therefore, Let It Be Resolved that the ASUM Senate updates and amends the following Bylaws in the following ways;

Section 2. Campaigning:
A. Campaigning, with the exception of primary petition signing, is defined as any activity which promotes the candidacy of one or more individuals for an office. This includes, but it is not necessarily limited to, scheduling appearances, the buying of votes with money, gifts, or alcohol, posting or publishing advertisements, holding a charity event such as a concert, rally or other social gathering, distributing literature, or lobbying a voter.

H. Campaign expenditures, including donations, by each candidate or write-in candidate shall be limited to these amounts:
1. President-Vice president team: The maximum expenditure allowed is $100 $150, with or without a primary election.
2. Business Manager: The maximum expenditure allowed is $100, with or without a primary election.
3. Senators: The maximum expenditure allowed is $100 $50 $75, with or without a primary election.
4. Candidates may choose to be reimbursed for campaigning expenditures to the amount of $10, dependent upon receipts following the General Elections. Expenditures exceeding $10 will be matched 50% by ASUM. Total ASUM contributions shall not exceed $50 $37.50 for Senate and Business Manager candidates and $75 $50 for President/Vice President candidates. All claimed expenditures for reimbursement must have receipts. Expenditures without receipts will not be matched by ASUM.

I. Each candidate, write-in candidate, candidate team, or party must document expenditures for the Elections Committee and made public by filing an expenditure form, complete with receipts, by 3 p.m. two days prior to the general election. Expenditure forms must be filed even if there are no expenditures. Candidates who do not fulfill these requirements will have their eligibility to run in the general election revoked, and the person succeeding them in rank from the primary election will have their eligibility reinstated.

Let It Be Further Resolved that the ASUM Senate adopt these changes to the Bylaws immediately.

SB30-06/07 - Resolution regarding an increase in the Curry Health Center Fee - passed 2/21/07 19Y, 0N on a roll call vote

Whereas, the Curry Health Fee funds the operation and range of service offered by Curry Health Center, including medical, dental, counseling, wellness, health enhancement, substance abuse, and sexual assault recovery service;

Whereas, the cost to maintain the current level of service to UM students is constantly rising due to inflation;

Whereas, in order to better serve increasing student demand for existing services, the Curry Health Center must hire certain new positions as outlined in their attached proposal;

Whereas, the Curry Medical Center must frequently update their infrastructure systems to be able to integrate properly with the rest of the medical community;

Whereas, these updates are usually capital expenditures (more than $5,000);

Whereas, $15,000 of the both the FY08 and FY09 budgets will used to build a capital reserve, ideally for the purchase of a digital radiography system (approximately $60,000);

Whereas, the Student Health Advisory Committee (SHAC) has approved the proposed FY08 and FY09 budgets for the Curry Health Center and unanimously endorsed the proposed fee increases for the corresponding years;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana (ASUM) endorses the following Curry Health Fee increases:

Fiscal Year 2007-2008:
Increase the Curry Health Fee (fall/spring semesters) from the current $148.75 to $159.00. This is an increase of 6.9% or $10.25.

Increase the Curry Health Fee (summer semester) from the current $72.00 to $75.00. This is an increase of 4.2% or $3.00.

Fiscal Year 2008-2009:
Increase the Curry Health Fee (fall/spring semesters) from the current $159.00 to $167.00. This is an increase of 5% or $8.00.

Increase the Curry Health Fee (summer semester) from the current $75.00 to $77.00. This is an increase of 2.7% or $2.00.

SB31-06/07 Resolution to Amend ASUM Bylaws Article V, Sections I and II - killed in committee

Whereas, candidates for the Associated Students of The University of Montana (ASUM) office previously had the ability to run under an official, regulated, student slate;

Whereas, candidates now are organizing together in unofficial and unregulated unions;

Whereas, the amount of money that unofficial slates can use puts them at a severe advantage over other candidates who do not organize with other candidates;

Whereas, setting slate expenditures at a base level of $75 ensures that single candidates can form slates without financial discrimination and adding an additional $25 for each additional slate candidate is a fair way to determine slate spending levels;

Whereas, regulating slates brings fairness to ASUM elections and avoids a number of potential questions that may arise from the uncertainty around how to manage candidates organizing together;

Whereas, students often enter into voting being poorly informed about the candidates they have the option of voting for;

Whereas, providing students with a basic background of where a candidate stands on important issues through ballot demarcation will benefit the democratic process;

Whereas, providing a guide to go along with these demarcations will ensure that voters are not confused as to their purpose;

Whereas, by requiring that each candidate be recognized on the ballot with a demarcation following their name ensures that no slate is given any advantage on the ballot;

Therefore, Let It Be Resolved that the following sections of Article V, Sections I and II be amended to read:

Section I, Sub point II:
2. A potential candidate must file a petition with the Elections Committee. Petitions are available from the Elections Committee and must consist of the signatures, printed names, ID numbers, and telephone numbers of at least 50 members registered during Spring Semester of the election. A student political party (slate) may present potential candidates for any or all elective positions upon petition of at least 50 students, registered during Spring Semester of the election, per potential candidate. The names of all potential candidates who are members of slates must be named on the petitions for that slate. Potential candidates for President must run with a potential candidate for Vice President as a single ticket, with a joint petition containing at least 100 signatures.

Section II, Sub point G-3
3. Senators: The maximum expenditure allowed is $75, with or without a primary election. A slate candidate may spend a base amount of $75 with an extra $25 for each additional member of the slate and a maximum amount of $300. This requirement also holds for executive candidates. For example, if a president/vice president candidacy and two Senate candidates formed a slate, their expenditures would be limited to $150. Business Manager candidates or President/Vice President teams running alone are entitled to slate status at their established maximum expenditure level for each position respectively.

Section II, Sub point H
H. Each candidate, write-in candidate, or candidate team, or slate must document expenditures for the Elections Committee and made public by filing an expenditure form, complete with receipts, by 3 p.m. two days prior to the general election. SB32-06/07 Resolution Supporting Fee Increase for KBGA Student Radio and Sending Proposed Fee Increase to Student Referendum - passed 04/4/07 19Y-2N on a roll call vote

Whereas, the KBGA College Radio Fee is the largest source of income for the station, followed by advertisement underwriting, then phone-in pledges from an annual radiothon;

Whereas, the second largest source of income has decreased significantly due to new FCC guidelines prohibiting underwriting for transitory events (i.e. concerts);

Whereas, the operating costs for KBGA are increasing due to rent increases and equipment rental fee increases;

Whereas, KBGA needs to build its “backup account,” used as an equipment reserve fund;

Whereas, the KBGA Radio Board has approved the proposed FY08 budget for KBGA and unanimously endorsed the proposed fee increases;

Therefore, Let It Be Resolved that the ASUM Senate will submit this proposal to a student referendum in April 2007, that shall read as follows:

The KBGA/Student Radio Fee is the only student-run radio station for UM students. KBGA employs 10 students staff members and has over 70 DJs. A $1 per semester fee increase will allow KBGA to raise wages of KBGA’s staff members to coincide with the Montana’s minimum wage increase build and build it’s equipment backup account.

SB33-06/07 Resolution opposing HB281 - passed 03/14/07 19Y-1N on a roll call vote

Whereas, HB 281 limits the opportunity Montanans have to vote;

Whereas, almost 7,500 Montanans registered during the late registration period;

Whereas, 3,947 Montanans registered and voted on Election Day;

Whereas, 683 college-aged Missoula voters took advantage of the extended registration period, and 72 of them had on-campus addresses;

Whereas, the turnout in the 2006 election was 63%, up from 54% in the previous non-presidential election;

Whereas, during the 2005 legislative session ASUM lobbied on and helped pass the legislation allowing extended registration time;

SB34-06/07 Resolution to send Montana Kaimin Fee Increase to Referenda - passed 4/18/07 18Y-4N on a roll call vote

Whereas, the Montana Kaimin is preparing to expand quality and access to their newspaper and online website;

Whereas, the Montana Kaimin needs assistance to continue their services due to price increases in multiple necessary items;

Whereas, the Montana Kaimin is making preparations to expand their website by adding more news and interactive features;

Whereas, the Montana Kaimin would like to occasionally include color printing to the newspaper;

Whereas, the Montana Kaimin would like to occasionally increase its circulation from approximately 5,000 newspapers per printing to 6,000;

Whereas, the Montana Kaimin’s printing costs have increased between $44 and $151 per issue depending on the number of pages, and the costs continue to rise;

Whereas, the Montana Kaimin’s staff is currently paid slightly above the minimum wage;

Whereas, other ASUM agencies’ staff have seen their pay increase to approximately $0.50 above minimum wage;

Therefore, Let It Be Resolved that the following question be placed before student voters during the 2007 ASUM General Election:

The Montana Kaimin is proposing a $1.00 increase to the Kaimin Fee per semester. They ask for this increase for the purposes of expanding their website, increasing their newspaper circulation, improving the quality of the newspaper circulation, improving the quality of the newspaper, assisting with the increasing costs of ink and printing, and increasing some Montana Kaimin student employees' salaries.

The Montana Kaimin is proposing a $0.50 increase for the 2007/2008 academic year followed by an additional $0.50 increase the following year for a total $1.00 fee increase of the Montana Kaimin fee over two years. They ask for this increase for the purposes of expanding their website, increasing their newspaper circulation, improving the quality of the newspaper, assisting with the increasing costs of ink and printing, and increasing some Montana Kaimin student employees' salaries.

SB35-06/07 Resolution to Congratulate the Lady Griz Basketball Teams - passed 3/21//07 with unanimous consent

Whereas, the Lady Griz Basketball Team represents The University of Montana to a broad range of audiences;

Whereas, the Lady Griz Basketball team set a school record for most wins in a regular season;

Whereas, the Lady Griz won the Big Sky conference regular season championship;

Whereas, the Lady Griz earned a national ranking in the AP Top 25 Poll for the first time in over a decade;

Whereas, the Lady Griz continue to be a source of pride throughout Montana and inspire future generations of female student athletes;

Whereas, Lady Griz Head Coach Robin Selvig was named 2007 Big Sky Conference Coach of the Year;

Whereas, The University of Montana, students, and Griz fans benefit from the continuing success of both teams.

Let It Be Resolved that the Associated Students of The University of Montana congratulate the Griz and Lady Griz Basketball Teams for their outstanding work this year;

Let It Further Be Resolved that the Associated Students of The University of Montana send a copy of this resolution to Coach Robin Selvig, Athletic Director Jim O’Day, and Judy Southard the NCAA Division I Women’s Basketball Committee Chair.
