Whereas, SB37-05/06 opposed the Stop Overspending Constitutional Initiative (CI-97);

Whereas, the Not in Montana Coalition would provide resources and a strong network for ASUM to work with in opposing CI-97;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana (ASUM) join the Not in Montana Coalition.

SB2-06/07 Resolution Regarding Bond Funds - passed 09/13/06 17Y-3N on a roll call vote

Whereas, The University of Montana took out a bond of $5.75 million, with a fixed annual percentage rate (APR) of 4.14%, to help build a new building for the Office of the Commissioner of Higher Education in Helena;

Whereas, this office building was going to be built in conjunction with the Montana Guaranteed Student Loan Program (MGSLP);

Whereas, MGSLP’s funding was cut by the federal government, preventing them from contributing their financial commitment;

Whereas, it is no longer financially feasible for the Commissioner’s Office to build a new building;

Whereas, The University of Montana now has this money available to do on-campus improvements;

Whereas, there are buildings on campus that are in need of renovations to bring them up to code;

Whereas, this money can also be used to supplement funding for on-campus projects being built primarily with private donations;

Whereas, the opportunity to invest this money will benefit students across the university;

Therefore, Let It Be Resolved that the Associated Students of the University of Montana (ASUM) support the Administration’s plan (see Exhibit A) to devote this unforeseen money to improve certain campus facilities.

Let It Be Further Resolved that ASUM support Academic Facility Fee increases of $50/semester for students in the Journalism and Law programs and $1.25 per credit hour to the Academic Facility Fee for all students.

SB3-06/07 Resolution Amending House Rules: Section 2 - passed 09/20/06 21Y-1N on a roll call vote

Whereas, the Associated Students of The University of Montana (ASUM) Senate consists of leaders elected by the students of The University of Montana;

Whereas, at all levels of government the votes that each elected official makes are recorded for public knowledge;

Whereas, there is no consistent record of individual votes cast on the vast majority of resolutions;

Whereas, the only reflection in the record of the stances each member of the ASUM Senate takes are those that are deemed important enough to require a roll call vote by members of the ASUM Senate;

Whereas, students have varying interests and concerns and may differ in what they believe is important from that of the ASUM Senate;

Whereas, the ASUM Senate and the students of The University of Montana value openness and accountability in those who represent them;

Whereas, every student attending The University of Montana is a constituent of every ASUM Senator and Executive;

Whereas, the ASUM Senate should reflect the ideals that they expect from other elected officials;

Whereas, it is to the benefit of the students of The University of Montana to know how each member of the ASUM Senate chooses to represent the student body;

Whereas, passage with unanimous consent would list every present member of the ASUM Senate as voting in the affirmative;

Whereas, the voting information should be easily accessible to students;

Therefore, Let it be Resolved, that ASUM House Rules Section 2 be amended to read:

K. The final vote on all resolutions voted on by the ASUM Senate requires a roll call vote unless approved by unanimous consent.

Let it Further be Resolved that ASUM be charged with posting the voting record of the ASUM Senate in the ASUM Display Case until the next meeting of the ASUM Senate.

Let it Further be Resolved that making this voting information accessible online be a goal of the ASUM Office Staff and Administration.

SB04-06/07 College of Technology Affairs Committee - passed 09/20/06 21Y-1N on a roll call vote

Whereas, ASUM said that it would “explore new avenues of involving COT student in student government activities” when it dissolved the COT Affairs Committee;

Whereas, instead ASUM dissolved the COT liaison position cutting all significant ties with our COT constituents;

Whereas, College of Technology students deal with a diverse number of issues, often very different from the issues at the mountain campus;

Whereas, most colleges of technology around Montana have their own student government, unlike The University of Montana-Missoula where they are represented under the same provisions as the Liberal Arts College;

Whereas, the channels currently used to get involved with ASUM and student activities are open to all students including the College of Technology; however, it is often harder to get informed about these opportunities and participate due to the separation from the mountain campus;

Whereas, ASUM has a commitment to serve all their constituents;

Whereas, due the special needs that the College of Technology students have separate from their counterparts on the mountain campus, a committee dedicated to serving them is much needed;

Therefore Let It Be Resolved that ASUM Bylaws Article IV be amended to read:
Section 18. College of Technology Affairs Committee (CTA):
A. The COT Affairs Committee shall be composed of seven (7) members, of which three (3) at least one (1) shall be a members of the Senate and four (4) at least two (2) shall be students at-large from the COT. Any student may be a non-voting advisory member of the Committee.
1. The Committee shall be structured so that COT students-at-large will maintain majority of voting membership.
B. A COT student-at-large or an ASUM Senator shall chair the committee.
C. The Committee shall be responsible for all activities occurring on the College of Technology campuses that affect the ASUM.
D. The Committee shall review the ASUM governing documents and recommend changes as necessary to meet the representation needs of students attending the College of Technology.
E . The Committee shall meet on the College of Technology campuses.

SB05-06/07 Resolution Temporarily Increasing the Limit on Billable Hours in Personnel Policy 3.0 - passed 09/20/06 with unanimous consent

Whereas, UM Productions is an agency of the Associated Students of The University of Montana (ASUM) whose personnel policy is governed by ASUM Personnel Policy;

Whereas, the Personnel Policy 3.0 limits the number of billable hours in a month to eighty (80) for the UM Productions Program Director, Pop Concert Coordinator and Performing Arts/Special Events Coordinator (currently known as Production Assistant);

Whereas, UM Productions is spearheading the effort to prepare for the Rolling Stones concert at Washington-Grizzly Stadium;

Whereas, the Rolling Stones concert will take far more effort and man-hours than any concert UM Productions staff has worked on before;

Whereas, the UM Productions Program Director, Pop Concert Coordinator and Production Assistant will all be working even further beyond their allotted hours than they already do;

Whereas, an increase in the billable hours for UM Productions employees would be funded from the budget of UM Productions, would require no additional funding from the ASUM Senate, and would not cause any financial difficulties for UM Productions;

Therefore, Let It Be Resolved that the Senate of the Associated Students of The University of Montana increase the number of billable hours for UM Productions Program Director to one hundred four and two/thirds (104.667) hours and the Pop Concert Coordinator and Production Assistant to one hundred six and two/thirds (106.667) hours, with overtime, for the first two-week pay period in month of October. (See Exhibit A.)

SB06-06/07 Resolution on Segway Purchases - passed with unanimous consent 10/11/06

Whereas, students at The University of Montana are against misappropriated spending and gross misspending;

Whereas, the benefits of using Segway personalized motorized transportation devices are not significant enough to justify the purchase of these devices;

Whereas, the use of these devices are extremely limited by weather conditions during the academic year;

Whereas, the upkeep and maintenance of these devices is expensive;

Whereas, the Office of Public Safety’s purchase of several new Segway personalized motorized transportation devices is an example of gross misspending;

Whereas, parking problems and parking efficiency on the campus of The University of Montana will not be resolved by this purchasing;

Whereas, a bicycle would be a sufficient and efficient alternative to these devices;

Whereas, any continued spending on personalized motorized transportation devices would be a continued example of gross misspending;

Therefore, let it be resolved that the Associated Students of The University of Montana (ASUM) disagree with the past purchase and discourage any future purchase(s) of personalized motorized transportation devices.

Whereas, Item 2, Section 2 of the ASUM Personnel Policy is outdated;

Therefore, Let It Be Resolved that ASUM amend the first sentence of its Personnel Policy Item 2, Section 2 to read: 2.2. All non-elected student positions must be advertised on the “Electronic Job Board.”

Whereas, Item 4, Sections 12 and 13 of the ASUM Personnel Policy contains redundant language vis-à-vis the ASUM Constitution;

Therefore, Let It Be Resolved that ASUM eliminates from its Personnel Policy Item 4, Section 12 and Section 13 the bulletins which directly quote the ASUM Constitution and amends the last sentence of each preceding paragraph to read:

The duties of this office are further enumerated in the ASUM Constitution.

SB07C-06/07 Resolution Amending ASUM Personnel Policy - passed 10/18/06 17Y-2N on a roll call vote

Whereas, the legality of Item 2, Section 4 of the ASUM Personnel Policy is questionable;
Whereas, working volunteer hours beyond the designated base hours is, and ought to be, a matter of honor and pride for ASUM employees and not a condition for their employment,
Therefore, Let It Be Resolved that ASUM amends its Personnel Policy Item 2, section 4 to read:
2.4 Positions with monthly designated base hours may not be compensated beyond that base. Any exceptions to this rule must be approved by the ASUM Executives and Senate. The Senate may provide retroactive approval for any exemptions made by the Executives during periods when the ASUM Senate is not regularly in session.

SB08-06/07 Resolution regarding Accessibility - passed 10/18/06 with unanimous consent

Whereas, The Associated Students of The University of Montana (ASUM) and their dedication to accessibility have recently been called into question by both letters to the editor and articles in The Montana Kaimin;

Whereas, the ASUM strive to be proactive regarding accessibility concerns;

Whereas, the ASUM have been diligently working to address accessibility issues with ASUM agencies and services, especially ASUM Transportation;

Whereas, the ASUM work with various University committees and groups to make UM more accessible to students;

Therefore, Let It Be Resolved that The Associated Students of The University of Montana (ASUM) reaffirm their strong stance in support of making ASUM agencies and services accessible to students at The University of Montana;

Let It Be Further Resolved that the ASUM will work to further build relationships with the Alliance for Disability and Students at The University of Montana (ADSUM) and identify accessibility issues with ASUM agencies and services, as well as on campus;

Let It Be Further Resolved that the ASUM will strive to continue to make The University of Montana accessible to all students.

SB09-06/07 Resolution Thanking MountainLine - passed 10/25/06 with unanimous consent

Whereas, ASUM Transportation works on a relatively tight budget and finds it difficult to locate funds for new buses;

Whereas, Mountainline Transportation gave ASUM Transportation two new buses, the first on August 31, 2006, and the second on September 28, 2006,

Whereas, students have been left at South Campus for lack of space on the buses, and the two donated buses have a larger ridership capacity than any of our other buses;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana formally thank Mountainline for their generous donation of two buses to ASUM Transportation.

SB10-06/07 Resolution Endorsing I-151 and joinining the Raise Montana Coalition - passed 10/25/06 17Y, 2N on a roll call vote

Whereas, the State of Montana has not had a minimum wage increase since 1996;

Whereas, according to the Center on Budget and Policy Priorities and Economic Policy Institute, the purchasing power of minimum wage has deteriorated by 20% since September 1997. After adjusting for inflation, the value of minimum wage is at its lowest level since 1955;

Whereas, the two largest student employers on campus, University of Dining Services and UM Productions, have a combined student employment of 901 students who are currently earning less then the proposed increase;

Whereas, the Associated Students of The University of Montana (ASUM) have a strong history of supporting minimum wage increases in the state legislature;

Therefore, Let It Be Resolved that ASUM support I-151.

Let It Be Further Resolved that ASUM join the Raise Montana Coalition.

SB11-06/07 Resolution Regarding Sustainability - passed 11/01/06 with unanimous consent

Whereas, in 2003 President Dennison signed the Tallories Declaration for The University of Montana;

Whereas, bullet point five of the Tallories Declaration states, “we agree to set an example of environmental responsibility by establishing institutional ecology policies and practices of resource conservation, recycling, waste reduction, and environmentally sound operations;”

Whereas, the ASUM has a unique opportunity to be leaders in the movement to implement aspects of this declaration;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana pledge to work towards a sustainable and ecologically friendly campus;

Let It Further Be Resolved that the ASUM and affiliated agencies will pledge to use 100% post consumer product paper for general printing uses;

Let It Further Be Resolved that the ASUM encourages departments and organizations on campus to implement aspects of the Tallories Declaration, including using 100% post consumer product paper.

Let It Further Be Resolved that a copy of this resolution be sent to all campus departments and organizations.

SB12-06/07 Resolution to amend ASUM Bylaws Article III, Section 2 - passed 11/01/06 with unanimous consent

WHEREAS Article III, Section 2E no longer exists within the ASUM Bylaws;

THEREFORE, LET IT BE RESOLVED that ASUM Bylaws Article IV, Section 2 be amended to read:
Section 2. Relations and Affairs Committee:
A. The Relations and Affairs Committee shall be composed of nine (9) members, four (4) of which shall be Senators.
B. The Relations and Affairs Committee shall be responsible for recommending all changes to the ASUM Bylaws and ASUM Personnel Policy.
C. The Relations and Affairs Committee shall work on unbiased projects, ideas, or campaigns intended to increase student involvement in and student awareness of ASUM government in general or any particular issue(s) pertaining to ASUM.
D. The Relations and Affairs Committee shall be responsible for all activities occurring on the University campus that affect ASUM and students. These activities include, but are not limited to: auxiliary service fees and operations, campus development plans, campus security, environmental health, insurance, parking, university athletics, computer fees, academic issues, library operations, long-range building plans, international student affairs, student health service, drug and alcohol policy, and building and equipment fees.
E. The Barbara Hollmann Administrator of the Year Award
1. At the last meeting of the outgoing ASUM Senate, this honor shall be presented to the recipient.
2. The recipient shall be chosen by the Relations and Affairs Committee through a nomination and discussion of potential recipients.
3. The recipient shall be judged on his/her ability to champion student issues.
4. The recipient must show a willingness to include students throughout the entire decision-making process on campus-wide issues.
5. The recipient must also show a willingness to listen to students with the goal of understanding concerns.
F. The Relations and Affairs Committee shall enforce and oversee the execution of Article III, Section 2E of the ASUM Bylaws. Therefore, a motion passed by a two-thirds majority vote in the Relations and Affairs Committee can and will result in an unexcused absence for an ASUM Senator failing to accord with Article III, Section 2E of the ASUM Bylaws. Such decisions of the Relations and Affairs Committee may be repealed by a simple majority vote of the ASUM Senate.
G. F. The Relations and Affairs Committee shall also oversee the functions of the following ASUM executive agencies, in accordance with ASUM Personnel Policy:
1. UM Productions. The UM Productions Director shall be appointed by the President and approved by the Senate by a two-thirds (2/3) majority vote.
2. ASUM Legal Services - Relations and Affairs shall act as a board of directors to oversee the Legal Services Director and its program.
3. ASUM Administration
H. G. Student directors may be removed from office as stipulated by University of Montana policy and ASUM Personnel Policy.

SB13-06/07 Resolution regarding UM Apparel - passed 11/08/06 with unanimous consent

Whereas, The University of Montana is an institution of higher education committed to educating students to be "informed, ethical, and engaged citizens of local and global communities";

Whereas, the current system of sublicensing Grizwear? through the Collegiate Licensing Company offers insufficient information about the source of the apparel;

Whereas, the Collegiate Licensing Company has a loose affiliation with the Fair Labor Association, which lacks the monitoring capability that the Worker Rights Consortium provides;

Whereas. affiliating with the Worker Rights Consortium will supply The University of Montana with essential information regarding currently unreported factory conditions, making these reports available to all students, faculty, and staff;

Whereas, signing on to the WRC's Designated Suppliers Program will allow The University of Montana to shift Grizwear? manufacturing to factories that promote fair labor standards thus enforcing UM's purchasing code of conduct;

Whereas, The University of Montana has the responsibility to promote fair labor standards in it’s business endeavors;

Therefore, Let It Be Resolved that ASUM supports The University of Montana affiliating with the Worker Rights Consortium and adopting the Designated Suppliers Program to ensure ethically responsible practices in regards to its apparel purchasing process.

SB14-06/07 Resolution in Support of MPACT - passed 11/01/06 with unanimous consent

Whereas, Montana received a grade of F for “Affordability” in Measuring Up 2006: The National Report Card on Higher Education;

Whereas, the average debt-load of graduating UM students is upwards of $20,000;

Whereas, there is a widening rift between the rise in the average household income and the increases in the cost of higher education for Montana’s students;

Whereas, these rising tuition costs and substantial debt loads have begun to discourage Montana high school graduates from attending college;

Whereas, UM President George Dennison proposed a plan entitled Montana Partnering for Affordable College Tuition (MPACT) that was approved on a provisionary basis for one year by the Montana Board of Regents;

Whereas, the MPACT program helps reduce debt load of students by roughly half, to an average of $10,000;

Whereas, MPACT program eligibility is based upon both financial and academic criteria;

Whereas, these eligibility requirements help ensure that academically successful students from low-income families can afford college;

Whereas, the number of currently enrolled UM students who meet the criteria is roughly double that of those who had previously enrolled without assistance;

Whereas, the program has been successful and has helped students;

Therefore, Let It Be Resolved that The Associated Students of The University of Montana (ASUM) thank President Dennison for his commitment to making higher education affordable to Montana students.

Therefore, Let It Be Further Resolved that the ASUM encourage the Montana Board of Regents of Higher Education to continue the MPACT program at The University of Montana.

Therefore, Let It Be Further Resolved that the ASUM urge the Board of Regents to thoroughly examine the prospect of making MPACT a system-wide program.

SB15-06/07 Resolution Regarding Governor Schweitzer’s College Affordability Plan (CAP) - passed 11/01/06 with unanimous consent

Whereas, tuition in the state of Montana has been on the rise since 1991;

Whereas, there is a widening rift between the rise in the average household income and the rises in the cost of higher education for Montana’s students;

Whereas, Governor Brian Schweitzer’s proposed College Affordability Plan (CAP) would hold in-state tuition at current levels for the next biennium;

Whereas, this hold will involve an additional $50 million in state support to help supplement rising operating costs of institutions of higher education;

Whereas, a hold in tuition increases will help ensure that Montana residents will not have to face the continually rising costs of higher education;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana (ASUM) thank Governor Brian Schweitzer for his proposal to cap CAP in-state tuition and promise to make college affordable for Montana residents.

Therefore, Let it Be Further Resolved that the ASUM will work diligently in the upcoming legislative session to make the proposed College Affordability Plan a reality for Montana.

SB16-06/07 Resolution condemning ‘Taser’ use by the Department of Public Safety - failed 11/29/06 6Y, 13N on a roll call vote

Whereas, the use of ‘Taser’ guns are both dangerous and unnecessary, especially on The University of Montana campus;

Whereas, the recent events at The University of California Los Angeles are evidence that the use of ‘Tasers’ are not only threatening to students and their ability to learn, but they also have potential legal repercussions that could be detrimental to The University of Montana and the Office of Public Safety;

Whereas, the Office of Public Safety has not shown that ‘Tasers’ are an effective method of deterrence;

Whereas, the students of The University of Montana believe that situations should be resolved peacefully;

Whereas, the use of ‘Taser’ guns are a violent method to conflict resolutions;

Therefore, Let It Be Resolved that the Associated Students of The University of Montana call upon the Office of Public Safety to discontinue the use of ‘Taser’ guns.

WHEREAS, the ASUM Transportation Board meets frequently and rigorously, and the ASUM Bylaws do not provide for necessary flexibility in committee structure;

WHEREAS, students’ trips to school begin when they leave home and end when they arrive at class. As per the ASUM Office of Transportation’s Mission Statement, it is in the best interest of students for the Board to take an active role in transportation planning around the Missoula area;

THEREFORE, LET IT BE RESOLVED that ASUM Bylaws, Article III, Section 14 be amended to read:

Section 14. Transportation Board:

A. The Transportation Board shall be composed of no less fewer than eight (8) six (6) five (5)and no more than ten (10) nine (9) voting members, of which no less than three (3) and no more than four (4) will be members of the ASUM Senate, no less than two (2) three (3) and no more than five (5) will be students-at-large, one (1) will be a resident life representative, and one (1) will be t The ASUMOT Director shall be an ex-officio member of the Board.. If possible, one (1) member will be a representative from residence life. The Transportation Advisory Board will consist of transportation oriented groups, agencies, and individuals. The ASUM Transportation Board will meet a minimum of twice monthly. The Advisory Board will meet with the Transportation Board at two of these meetings per year. Committees will be made up with members from either the Transportation Board and/or the Advisory Board.

B. The committee Board shall be chaired by the ASUMOT Director, who shall vote only in the case of a tie a student member of the Board. If the chair is a student-at-large, he or she and the ASUM President must arrange a method to regularly brief the senate on actions of the Board.

C. Quorum shall consist of a simple majority of those members currently holding positions. This committee The Board shall meet and have quorum at least two (2) times per month during the academic year.

D. The Board shall, if needed, establish relevant sub-committees which may include a) Fees and Finance, b) Bike and Pedestrian Safety, and c) Transportation Planning.

D. E. Duties and functions of the Transportation Board include:
1. Annually reviewing the ASUMOT budget, the transportation fee, the services provided by ASUMOT, and the performance of the ASUMOT Director;
2. Giving a binding vote on projects amounting to 2% or more of the ASUMOT budget;
3. Submitting for approval to the ASUM Senate any project which a) amounts to 6% or more of the annual ASUMOT budget, and b) is approved in committee by anything less than a unanimous decision of all members present.
4. Meeting with a variety of transportation oriented groups, agencies, and individuals for input and planning.
5. Taking steps to influence transportation planning in the greater Missoula area. The Board shall review transportation projects in the Missoula area and evaluate them for sustainability, cost effectiveness, quality of life influences to neighborhoods, ease of accessing transit, connectivity and access to trail systems and influence on bike and pedestrian safety. The Board shall issue position statements when appropriate encouraging responsible transportation development.

4. 5. 6. Developing a short term (one year) plan to be decided at the first meeting within the first three meetings of each academic year. A long range (five three or more years) planning goals is to be decided upon at the first meeting of this committee plan shall be developed throughout the academic year to serve as guidance for future Boards. This plan should be finalized no later than March 31 of each year. Both plans may be amended at any point with a two-thirds (2/3) majority

SB18-06/07 Resolution Regarding Reconfiguration of Russell and South Third Streets - passed 11/29/06 16Y, 3N on a roll call vote

WHEREAS, many students walk, bike, or use public transit to get to campus;

WHEREAS, affordable housing is difficult for students to find in Missoula;

WHEREAS, a five-lane roadway on Russell Street would decrease pedestrian and bicycle safety, increase vehicle speeds, remove good housing stock from the core of Missoula, negatively affect neighborhood character, induce additional traffic and create a Reserve-style street in the core of Missoula;

WHEREAS, the supposed need for a five-lane roadway is justified based on straight-line traffic projections and does not take increased use of public transit and other alternative means of transportation into account;

THEREFORE, LET IT BE RESOLVED that the Associated Students of The University of Montana (ASUM) do not support a five-lane option with 12.5-foot travel lane widths on Russell Street. ASUM will also oppose any plan that calls for removing an excessive number of houses.

LET IT FURTHER BE RESOLVED that ASUM will support a three-lane system with center turn lanes and single lane roundabouts on Russell Street and a two-lane system with single lane roundabouts on South Third Street. ASUM also supports bulb-outs at intersections, speed tables, pelican crossings and turning lanes when appropriate, and trail underpasses.

A representative from the ASUM Office of Transportation shall attend the Broadway Charette and encourage the City of Missoula and the consultants involved in the planning process to consider a roundabout system at the intersection of Broadway and Russell Streets as an efficient intersection system as well as an attractive gateway to the downtown area.
