What promises will society enforce? What roles do lawyers and courts play in the agreement process? The courses explore the traditional issues of contract law, including formation, performance, and damages, through the analysis of cases. On the assumption that lawyers will draft contracts far more often than they will litigte contract cases, the courses also emphasize drafting skills and the practice of preventative law—planning things right, not merely cleaning up after things have gone wrong.
