Professor Patrick Duffy

In Civil Procedure students learn that the Montana Rules of Civil Procedure are based on the Federal Rules of Civil Procedure.  As such, Federal Courts does not return to any focus on Federal Rules.  Instead, the focus of the course is on the limited nature of federal jurisdiction itself, and the types of cases and controversies decided in the federal system - both civil and criminal.  Significant attention is also paid to the practical aspects of practice in federal court, including an introduction to electronic filling, survey of Local Rules, and attendance at actual Court proceedings.  Finally, the course provides instruction on the framework and the operation of the Judiciary as a separate branch of government.

This course is for any person interested in the nature of federal courts, and is particularly suited to those who intend to practice as trial attorneys in that jurisdiction.
