Natural Resources Development
explores legal doctrines and conflicts associated with
the ownership, allocation, use and protection of various
resources including timber, minerals and water. The
course also covers energy law issues such as wind power
development and electric power generation and distribution.
The course evaluates how resource rights arise from
land ownership and how rights may be severed and acquired
separate from land. We also consider a
variety of practical legal issues such evaluating resource
title issues, structuring resource transactions, and
understanding regulatory schemes have been used to
alter resource ownership and allocation. Finally,
we touch on some of the unique environmental legal
problems associated with resource and energy development,
with particular focus on difficult legal issues associated
with decades of hard rock mining. Grade
is based on a take-home examination and class participation. |
