RECENT AND FUTURE CHANGES IN FEDERAL AND STATE CIVIL PROCEDURE

Professor Juras will discuss recent court decisions in the areas of business, estate and property law. In the area of estates, cases will include the Montana Supreme Court's discussion of the fiduciary duties of trustees, its interpretation of the intent required under the Montana slayer's statute, the appropriate valuation date to use in making distributions from estates, and several cases concerning procedural requirements under the Montana probate and trust code. In the area of business law, Professor Juras' discussion will include commercial law, covenants not to compete,  and a refresher on the laws governing registered agents that became effective October 1, 2008. In the area of property law, the discussion will include recent decisions concerning easements and stream access for recreational purposes.

AULD LANG SYNE:  Silver and Gold Rules of Civil Procedure.

We're naturally resistant to change, and naturally subject to it. The key is to keep auld acquaintances and make new ones, and this CLE will help you do that. The Federal Rules were amended substantially recently; this CLE will introduce you to the amendments. It will also discuss the Montana Rules of Civil Procedure, and alert you to similarities and differences between the state and federal rules. So put "Update on Civil Procedure Rules" on your resolution list, and check it off before January expires. It's easier and more fun than losing weight...plus it's free.
