Jurors receive their instructions from Molloy

inkwell.jpg The beginning of the end of the W.R. Grace trial started Wednesday morning as Judge Donald Molloy walked jurors through jury instructions and the prosecution started to present its closing argument.

Molloy discussed more than 50 separate instructions with the jury immediately after they entered the courtroom.

“You must not single out some (instructions) or ignore others, they are all equally important,” Molloy said.

The jury was also told that they could not consider the testimony of Robert Locke, a disgruntled former global vice president for Grace’s construction division, when deciding on the charges of Bettacchi. They should also look at Locke’s testimony with “more bias” than other witnesses, Molloy told the jury.

Jurors were directed to throw out a part of the testimony of Dr. Alan Whitehouse, a pulmonologist who treated many former W.R. Grace employees. Molloy told jurors that Whitehouse’s predictions about asbestos were to be disregarded, but the rest of his testimony was to be considered.

To help the jury come to a unanimous verdict more easily, Molloy gave definitions of many words that have been frequently used throughout the trial and in the indictment. The defined words were: release, ambient air, asbestos, imminent danger and serious bodily injury.

“This is in your hands,” Molloy told the jury before a short recess.

This trial is much like that Eagle at the top of this page. ( To those not familiar with Libby, it is at the head of the “gut” in Libby) Look a little close and you’ll notice it’s legs are connected almost to it’s neck. This is what the artist wants you think of as an Eagle,- big wings, claws and a bad ass beak. But if it was to “spring to life” if wouldn’t have the strength to flap those mighty wings, much less soar in the heavens as an Eagle.
The justice will be justice as much as that Eagle is an Eagle.

Hey John, May I suggest on behalf of Les Skramsted, a true Gladiator for the people, as myself, who has passed before his day in this court against those who did this to him. One of the things that will always ring out in the words this great friend spoke when he addressed the celebration of the Eagle on the gut as missing a mask and a Oxygen tank and hose. The crowd roared with agreement but the Mayor wasn’t amused. Imagine that will ya??? Anyway John, when the Guilty sounds ring in the Valley like a Micro burst full/FULL, of Tremolite asbestos fibers and the people look up as the clouds break and the sun bursts into flames and the Earth burns up…………Damn, did I get carried away…You get my point. Stay away from Libby.Thank you and you are all very very very welcome. Tell your friends and family and even a no body. Not even pets.
