Procedures

Lobbying

The University of Montana is required to disclose any lobbying activities, as defined by law. Pertinent legislation includes:

  • Title 31, United States Code, Section 1352 (known as the Byrd amendment) entitled "Limitation on use of appropriated funds to influence certain federal contraction and financial transactions." The regulations were issued in the Federal Register (54 FR 52306-32) December 20, 1989, and clarification was issued in the Federal Register (55 FR 24540-42) on June 15, 1990.
  • Public Law 104-65, "Lobbying Disclosure Act of 1995;" Amended by Public Law 105-66, "To make certain technical corrections to the Lobbying Disclosure Act of 1995."

The U.S. Senate offers Lobbying Disclosure Act Guidance (LDA) and states: "This combined guidance document does not have the force of law, nor does it have any binding effect on the United States Attorney for the District of Columbia or any other part of the executive branch. To the extent that the guidance relates to the "accuracy, completeness and timeliness of registration and reports," it will serve to inform the public as to how the Secretary and Clerk intend to carry out their responsibilities under the LDA."
