RE: Export Control Compliance
UM Research, in coordination with UM Office of Legal Counsel, recently issued a Policy on Export Controls. The policy makes clear that the University of Montana and its employees, visiting scientists and scholars, and all other individuals performing activities on behalf of the University are committed to complying with U.S. export control laws, regulations, and policies.
We ask that you take the time to familiarize yourself with the policy and seek guidance from the UM Export Control Office prior to engaging in any activity that may implicate export controls. Examples of such activities include:
- Research awards or contracts which restrict either publication of results or foreign national involvement;
- Shipment or transfer of export-controlled information, technology, technical data or items outside of the United States, whether temporarily or permanently;
- Transfer of export-controlled information, technology, or technical data to a foreign national located within the United States when such transfer would constitute a deemed export requiring approval pursuant to export control laws, regulations, or policies;
- International Travel;
- Interaction with a citizen of or an entity located in a comprehensively sanctioned country, including travel to, importing or exporting to or from, signing agreements, building partnerships, and engaging in online education with an individual located in a sanctioned country;
- Research involving export-controlled information, technology, technical data or items which are enumerated on either the United States Munitions List or Commerce Control List;
- International Material Transfer Agreements (MTAs); and
- Non-Disclosure Agreements indicating the exchange of export-controlled information.
Failure to comply with export control laws, regulations, and policies can result in significant penalties for both the University and the individual. Please do your part to meet the University’s commitment to compliance with all applicable export controls.
